ZZZ IDE Terms and Conditions

1. Service Overview

1.1 Product Description

ZZZ IDE is a professional mobile development environment for Kotlin applications on Windows devices, built with Rust and featuring:

  • Advanced code editor with Rust/egui framework integration
  • Device mirroring capabilities through scrcpy integration
  • AI-assisted coding features via OpenRouter API
  • Comprehensive build system with emulator support

1.2 Service Provider

This service is provided by an individual developer ("Developer") operating from Colombia as a natural person. The Developer may incorporate in the future but currently operates as a sole proprietorship providing professional software development tools.

1.3 International Service Provision

This is a legitimate cross-border digital service transaction. The Developer provides software services internationally, which is legally permissible under international trade regulations for digital services. By using this service, you acknowledge this is an international software service purchase from Colombia.

2. Eligibility and Account Requirements

2.1 User Requirements

To use this service, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter contracts in your jurisdiction
  • Comply with applicable laws in your location regarding software purchases

2.2 Account Management

Premium features require account registration through GitHub OAuth integration with Supabase. You are responsible for maintaining account security and must notify the Developer immediately of any unauthorized access.

2.3 International Use

Users may access this service from any jurisdiction where such access is legal. You represent that your use of this service complies with all applicable laws in your location.

3. Subscription Plans and Payment

3.1 Available Plans (USD)

  • Developer Plan: $20/month - Full IDE access with 70 emulator builds per month
  • Pro Plan: $30/month - Full IDE access with unlimited emulator builds

3.2 Payment Terms

  • Monthly billing processed through Polar.sh
  • Payment due in advance for each billing cycle
  • Automatic renewal unless cancelled before next billing date
  • All sales are final - no refunds, credits, or prorated charges

3.3 Price Modifications

The Developer reserves the right to modify subscription prices with 30 days written notice. Existing subscribers will maintain current pricing for 60 days following any price increase.

3.4 International Transactions

You acknowledge that this is an international transaction and are responsible for any applicable taxes, duties, or fees in your jurisdiction. The Developer will comply with Colombian tax obligations related to international service provision.

4. Service Provision and Third-Party Dependencies

4.1 Service Availability

The service is provided "as is" and "as available." While the Developer strives to maintain reliable service, no guarantees are made regarding uptime, performance, or uninterrupted availability.

4.2 Third-Party Integrations

The service incorporates:

  • OpenRouter API: For AI-assisted coding features (you are responsible for any additional API costs)
  • scrcpy: Open source device mirroring (Apache 2.0 license)
  • Rust/egui: UI framework components (MIT license)

The Developer is not liable for third-party service interruptions, changes, or associated costs.

4.3 Service Modifications

The Developer reserves the right to modify, update, or discontinue service features at any time. Material changes will be communicated when reasonably possible, but advance notice is not guaranteed.

5. Data Handling and Privacy

5.1 Data Collection

The service collects only data necessary for:

  • Account authentication (via GitHub OAuth)
  • Payment processing (handled by Polar.sh)
  • Service functionality and improvement

5.2 Data Usage and International Transfers

  • Data may be processed in Colombia and other jurisdictions as necessary for service provision
  • Personal data is never sold to third parties
  • Data is retained only as long as necessary for service provision and legal compliance
  • Upon account termination, personal data is deleted within 30 days, except as required by law

5.3 Cross-Border Data Processing

By using this service, you consent to the international transfer and processing of your data as necessary for service provision.

6. Intellectual Property Rights

6.1 User Content

You retain all rights to code, projects, and content you create using the service. You grant the Developer a limited, non-exclusive license to process your content solely as necessary to provide the service.

6.2 Service Intellectual Property

All service code, designs, trademarks, and proprietary elements remain the exclusive property of the Developer.

7. User Responsibilities and Prohibited Uses

7.1 Acceptable Use

You agree to use the service only for lawful purposes and in accordance with these terms. You are prohibited from:

  • Attempting to reverse engineer, hack, or compromise the service
  • Sharing account credentials with unauthorized parties
  • Using the service for illegal activities or purposes
  • Engaging in abusive behavior toward other users or support staff

7.2 Compliance Representation

You represent that your use of the service complies with all applicable laws and regulations in your jurisdiction.

8. Termination

8.1 Termination by User

You may cancel your subscription at any time through your account dashboard. Cancellation prevents future billing but does not result in refunds for the current billing period.

8.2 Termination by Developer

The Developer may terminate your access immediately for:

  • Violation of these terms
  • Abusive behavior or harassment
  • Excessive resource usage impacting service quality
  • Non-payment of subscription fees
  • Any conduct deemed harmful to the service or other users

9. Limitation of Liability and Disclaimers

9.1 Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM, WITH A MAXIMUM LIABILITY OF $500 USD.

9.3 Excluded Damages

THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, data, or business interruption
  • AI-generated code errors or security vulnerabilities
  • Build failures or emulator malfunctions
  • Third-party service outages or API changes
  • Data loss due to user error or system failures

10. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from any claims, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the service or violation of these terms.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These terms are governed by Delaware law, United States, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Delaware.

11.3 Class Action Waiver

You waive any right to participate in class action lawsuits or class-wide arbitrations. All disputes must be resolved on an individual basis.

12. International Service Acknowledgment

12.1 Cross-Border Service

You acknowledge that this service is provided by a Colombia-based developer to international customers. This constitutes a legal international software service transaction under applicable trade regulations.

12.2 No Local Presence

The Developer operates remotely from Colombia and maintains no physical presence, employees, or assets in other jurisdictions.

12.3 Regulatory Compliance

The Developer provides digital services in compliance with applicable Colombian regulations for international software service provision. Users are responsible for compliance with regulations in their respective jurisdictions.

13. General Provisions

13.1 Entire Agreement

These terms constitute the entire agreement between you and the Developer and supersede all prior agreements and understandings.

13.2 Modifications

The Developer may modify these terms at any time by posting updated terms. Material changes will be communicated via email when reasonably possible.

13.3 Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
